Enforcement as a effectiveness criterion of legal regulation
The article deals with the removal of legal gaps in Russian criminal legislation, improve the efficiency of execution of criminal sanctions and the level of security of the society and the state. The analysis is performed in the context of the application of the institute replacement of the unserved part of the punishment by deprivation of liberty for minors convicted maliciously evading punishment in the form of mandatory corrective labor, restrictions on freedom, if they can not be sentenced to imprisonment in accordance with Part 6. Art. Penal Code of the Russian Federation.
