The article focuses on some discussion points that are reflected in S. A. Bochkarev’s monographic study “Philosophy of criminal law: questioning,” published by Norma Publishing House in 2019. The authors analyzed this study through the prism of educational, ontological and prognostic functions of the philosophy of law branches. Attention is drawn to the positive trend in the formation of branches of law. Concern is expressed about the possibility of stretching the boundary of meanings that separates the theory of legal branches and their philosophy due to the incorrect definition of the range of issues that make up the philosophical basis of the law branch. The question of the relationship between the philosophy of criminal law and criminal law policy is raised. The following points are considered in the positive light: the author’s emphasis on the need to cross the border of criminal law knowledge; the narrowness of approaches using a purely industry-specific set of techniques; the study of the sustainability of the fundamental values of law in times of social upheaval (revolution); disagreement with the diminution of the role of law-making initiative in the criminal law sphere on the part of representatives of the legislative branch of government and the dominance of the implemented initiatives of the president and the executive branch; a thorough analysis of the special order institution from the position of the value load on criminal proceedings; detailed coverage of hermeneutic problems of criminal law, etc. Controversial issues are thesis about the existence of criminal law (that is, the possibility of dismemberment of being), the exhaustion by the history of its methodological potential, understanding as a metanorm of law, the fact of ascertaining a loss in the fight against crime, the hope of consistency as the most “convincing and probably reliable indicator of the state criminal law in general» and others. In the final part of the article attention is drawn to issues that need to be understood, and the need to develop a philosophy of penal law is emphasized.
