Ideas sociological school of criminal law and their demand in the legislative practice
The article discusses ideas of the sociological school of criminal law and their demand in the legal practice. In the article are analyzed and compared the currently topical assertions of E. Ferri, A. Prince, and other members of the designated direction on the relationship between criminal penalties and measures of social protection, the role of government in the fight against crime, the classification of criminals and the causes of their behavior, special warnings, individualization of punishment, etc. The author concludes that the presented concept of non-punitive impact remained of unclaimed of life because of a fundamental inconsistency with the provisions of criminal law, ensuring the legality and fairness in the administration of justice.
