On some aspects of criminal liability for sexual battery in relation to persons under the age of twelve
The article deals with the justice problem of attribution of some sexual battery in relation to persons under the age of twelve to violent, qualified by p. «в» part 4 of Art. 132 of the Criminal Code of RF, with the appropriate amount of punishment in the form of imprisonment in the sanction of article. On the basis of the study of theoretical aspects and practice of sanctions the author comes to the conclusion about the injustice of the current version of the criminal law norm, which, taking into account the notes to Art. 131 of the Criminal Code of RF, refers sexual battery to lewd acts, actually allowing the application of criminal law by analogy. Also unfair is the sanction of part 4 of Art. 132 of the Criminal Code of RF, which does not correspond to the nature and degree of public danger of the act and is not consistent with other criminal sanctions, such as the sanction of part 2 of Art. 105 of the Criminal Code of RF. The studying of practice application of sanctions shows that the courts in the vast majority of cases under part 4 of Art. 132 of the Criminal Code of RF of the Criminal Code of RF prescribe penalties not only below the midpoint of the sanctions article, but below the lower limit, which also confirms the conclusion about the injustice of the consideration of the criminal law norm. The results of the study indicate the need to adjust the notes to Art. 131 of the Criminal Code of RF and sanctions part 4 of Art. 132 of the Criminal Code of RF.
