Some problems of terminology used in the Criminal Code of the Russian Federation to determine the age of juveniles
The article deals with the criminal-legal meaning of the “minor” concept, examines the norms of the General and the Special part of the Criminal Code that uses the concept both to set the age of criminal responsibility, and to identify core and qualifying attributes of various crimes. The author reveals the shortcomings and contradictions in the legislative confirmation, and in the determination of the “minor” concept and other allied definitions in practice. On the basis of the conducted analysis the author has formulated the proposals for amending and supplementing the existing legislation aimed at strengthening the penal protection of minors and removing the uncertainty of the law.
