Administrative prejudice in criminal law: from criticism to understanding
The article is devoted to the analysis of the evolution of administrative prejudice in
domestic criminal law and criminology. The provisions of regulatory acts, the points of
view of pre-revolutionary, soviet and modern scientists are analyzed. The authors attribute
the presence of pre-normative norms to the theory of a dangerous state of a person.
The concept of a dangerous state of a person and pre-regulatory standards as one of
the technical and legal embodiments of this concept are traditional for Russian criminal
law and criminological science. Administrative prejudice can be considered as a means
of pre-criminal individualization of criminal law measures. Pre-regulatory standards are
a means of humanizing criminal law, as they leave a second chance to a person held
administratively liable and do not criminalize (or decriminalize) an act committed for the
first time. The authors consider pre-regulatory standards as a means of achieving the goal
of preventing socially dangerous acts.
