The scientific and theoretical model of the General part of the New Penal Code of the Russian Federation: in search of a compromise
The author gives an evaluation of the scientific and theoretical model of the General part of the new Penal Code of the Russian Federation, criticizes the proposition of the project developers to give a priority to the correction of convicts, substantiates the necessity to apply a common approach to correcting and preventing crime through the prism of the concept «preventive-corrective effect», underlines the significance of expanding the legal regulation subject of Russian criminal executive legislation by including all measures existing under the criminal law, the paper gives a positive evaluation of the authors’ proposals on giving legal relations on the execution of punishments the procedural nature, on the need to regulate the status of all the main participants in this process, assesses the proposed system of institutions and bodies executing punishments.
