the article is devoted to the search for valid alternatives to imprisonment – punishment, which remains the basis of the entire system of establishing and implementing criminal liability. The processes of digital transformation of society have a significant impact on the specifics of the realization of individual rights, freedoms and legitimate interests, as well as form new “digital rights” for each person. Therefore, it cannot be ruled out that in the society of digital transformation, physical restriction in space will not be so painfully perceived by a criminal as the deprivation or restriction of access to network resources, through which the vast majority of rights and legitimate interests, the ability to perform work or provide services remotely, will be realized. Methods: comparative legal, empirical methods of description, interpretation; theoretical methods of formal and dialectical logic; private scientific methods of content analysis and interpretation of legal norms. Results: the analysis shows that information and telecommunication tools and technologies are already playing a very important role in all spheres of life for people under the age of 25. Even the limitation of the time of using these funds is perceived by the experiment participants as extremely painful. The purpose of this work is to assess the importance of information and communication technologies, Internet resources and other means of digital communication. An experimental study of their importance in the complex spheres of human daily life is conducted. On this basis, it can be pointed out that it is promising to find an alternative to the physical isolation of a convicted person from society in the field of deprivation/restriction of access to information and telecommunication means of communication, digital services and other digital resources to ensure realization of the individual rights, freedoms and legitimate interests.
