Regime of special conditions in the penal institutions of the Commonwealth of Independent States
A Model penal code became the legal reference point in establishing the special conditions regime in the penal institutions of ten participants of the Commonwealth of Independent States. The national penal laws of all countries of the Commonwealth contain legal norms on the regime of special conditions, the grounds for its introduction, the terms of validity, and the conditions. There are three groups of grounds for introducing a regime of special conditions: a) known and unknown to the Model Code b) general and c) specific grounds. The peculiarities of the procedure for the introduction of the special conditions regime in almost all states coincide: in some codes there is a specific official authorized to enter the regime of special conditions, in others reference to other legal acts is required. A definite or indefinite period of the special conditions regime is established. There is a specificity in determining the scope of restricted (suspended) rights: reference to the rights provided by the code, a reference to individual articles, an indication in the article of specific rights. In a number of countries these legal relations find their continuation and development in the by-laws. At the same time, the concept of a special conditions regime is not formulated at the legislative level, its purpose and tasks, it is required to clarify the list of restricted rights of convicts, specify the procedure for the actions of interested authorities and officials during this period, formulate norms on the regime of special conditions for convicts without isolation from society.
