Some aspects of mortgage as a way to ensure execution of obligations
the article deals with historical and basic general theoretical approaches to the research of proprietary rights that ensure the proper execution of obligations, in particular mortgage. the author claims that the mortgage also existed in prerevolutionary russian law. Further is made a comparative analysis of the location of mortgage standards in civil law beginning with the Civil Code of the rSFSr of the 1922. It is said that in the modern german law there is no this kind of property right as the right to sell someone else’s things. the article points out that in modern russian civil law the subject of the pledge can be things and property rights. types of mortgage are considered, which are distinguished on the grounds: at the location of the pledged property (fixed mortgage, mortgage); the subject of mortgage (mortgage of property and mortgage of rights); degree of connectedness of the pledged property with the land (mortgage of movable property and
mortgage of immovable property (hypothecation)).
there is a special type of mortgage - a subsequent mortgage. the authors disclose the procedure for foreclosure on mortgaged property, the basis of which is the failure or improper performance of the principal obligation by the debtor. It is concluded that to security rights, that is to mortgage is also a mortgage of real estate - a mortgage, whose real nature is disputed in scientific literature.
